A 54-year-old District Court Prosecutor, Thandwa Johanna Moseneke, stationed at the Pretoria Magistrates’ Court, has been released on R3,500 bail by the Pretoria Specialised Commercial Crimes Court.
Moseneke faces charges of corruption or, alternatively, defeating the ends of justice, following allegations she accepted a bribe to prevent a theft case from going to court.
How the Alleged Bribe Unfolded
The allegations date back to July 2021, when a man was arrested for stealing medicine from his employer and processed at Wierdaburg Police Station.
After being granted bail, the man allegedly agreed to pay the investigating officer R5,000 to stop the case from proceeding. He initially handed over R2,000 cash, and later an additional R3,000 via his wife’s bank account.
According to court documents, the investigating officer then gave R1,000 to Moseneke in exchange for her not enrolling the matter. As a result, the case was declined for prosecution, and the accused never appeared in court.
Complaint and Investigation
The employer, frustrated by the lack of prosecution, lodged a complaint with police management. This triggered an internal probe, which exposed the investigating officer’s role in the alleged bribery.
The officer was dismissed from SAPS after disciplinary action and later pleaded guilty to corruption in terms of a plea and sentence agreement. He was handed a five-year suspended sentence and confirmed in his plea that he paid money to Moseneke.
Prosecutor Hands Herself Over
Moseneke was formally charged after turning herself in at the Wierdaburg Police Station on September 11, 2025. Her bail was granted by the court under severe guidelines:
- No interference with state witnesses.
- You must notify the investigating officer before leaving Gauteng.
- No application for a new passport.
- No further offences.
The case has been postponed to 8 December 2025 for further investigation.
NPA: No One Above the Law
NPA spokesperson Lumka Mahanjana said the matter demonstrates the authority’s commitment to fighting corruption, even within its own ranks.
“To guarantee a comprehensive inquiry and preserve public confidence in our institutions, we are collaborating closely with law enforcement,” Mahanjana stated.
