KwaZulu-Natal Police Commissioner Nhlanhla Mkhwanazi has filed a R5 million defamation lawsuit against private investigator Paul O’Sullivan. The case, lodged at the Johannesburg High Court last week, centres on allegations that O’Sullivan publicly damaged Mkhwanazi’s reputation.
The Allegations
According to the court summons, O’Sullivan made three separate public statements this year accusing Mkhwanazi of financial misconduct during his time as acting National Police Commissioner. These included claims that Mkhwanazi misused police funds, accepted luxury gifts from service providers, and maintained links to organised crime.
The remarks also touched on other high-ranking police officials, including Crime Intelligence head Dumisani Khumalo and National Commissioner Fannie Masemola.
Mkhwanazi’s Demands
In his legal papers, Mkhwanazi is seeking R5 million in damages, alleging the comments tarnished his personal and professional reputation. He says he had previously asked O’Sullivan to publicly withdraw his statements and issue an apology, something O’Sullivan has refused to do.
O’Sullivan’s Response
O’Sullivan has declined to engage directly with the lawsuit in the media, calling it “sub judice.” However, in a formal response on Tuesday, he insisted he holds credible evidence to back his allegations. He added that he intends to present this evidence before the Madlanga Commission of Inquiry.
What Happens Next
The matter will now proceed through the High Court, where both sides are expected to present their cases. If successful, Mkhwanazi could secure one of the largest defamation payouts in recent police history.
