According to court documents, Ndiki initially owed over R500,000 to SARS. After interest of over R67,000 and penalties of R28,000 were applied, the debt skyrocketed to R600,000.

SARS sent Ndiki a final letter of demand on June 20th, threatening to take legal action if he didn’t pay his outstanding amount within 10 days.

The letter warned that not making the payment could lead to:

  • Attachment and auctioning of assets.
  • SARS appointing a third party (such as a bank or employer) to deduct funds.
  • A civil judgment being entered against him.
  • Options for debt restructuring based on financial hardship or basic living expenses.

SARS Offers Alternatives

SARS advised Ndiki to apply for:

  • Debt suspension in the event that a legal dispute is filed.
  • Reduction of repayment in cases of financial hardship.

Despite these options, SARS moved ahead with its court application after Ndiki allegedly failed to comply.

What’s Next for Moshe Ndiki?

Ndiki has refused to provide specifics of the purported abnormalities, despite his insistence that fraud is the root of his tax problems.

The case highlights the ongoing challenges faced by South African celebrities with SARS compliance, with several high-profile figures previously making headlines over tax disputes.

For now, Ndiki says he is determined to clear his name and resolve the matter directly with SARS.
